GENERAL TERMS AND CONDITIONS OF SALE

2. Purpose

These General Terms and Conditions of Sale (GTC) govern the contractual relationship between Firefightgroup SL and any individual of legal age acting as a consumer who:

• upon subscribing to a bi-monthly Firefightbox subscription
• when purchasing retail products

The main service consists of sending a surprise box every two months containing products related to the world of firefighters, sports and wellness.

3. Acceptance

All orders imply unreserved acceptance of these Terms and Conditions.

The applicable terms and conditions are those in effect on the date of the order.

4. Capacity

The Client declares that he is of legal age and has the legal capacity to enter into a contract.

5. Geographical area

The products are delivered within the European Union.

6. Bimonthly subscription

6.1 Operation

The subscription includes the delivery of a box every two calendar months.

The products are surprise products, not known in advance.

6.2 Contract Formation

The contract is formed after confirmation of payment and sending of a confirmation email.

Firefightgroup SL reserves the right to cancel any order in the event of a manifest error or suspicion of fraud.

6.3 Price and payment

Prices are shown in euros (€) including VAT.

The first payment is made at the time of ordering.

The following payments are automatically debited every two months.

The Client can cancel before the next expiry date.

Any abusive dispute regarding payment may result in suspension of the account and recovery of the sums owed.

7. Termination

The Customer can cancel:

• from his personal space
• or by email to sav@firefightbox.com

The cancellation takes effect for the next payment date if it occurs before the payment is taken.

Any box already paid for remains due and will be shipped.

8. Delivery

The products are delivered to the address provided by the Customer.

8.1 Specific Deadlines – Bimonthly Subscription

For subscribed customers:

The packages are prepared and handed over to the carrier between the the 25th and the 30th (or 31st) of the month in which the payment was made.

The reception can take place up to the 10th of the month following shipment, depending on the carrier's delivery times.

These timeframes are indicative.

In any event, delivery will take place within a maximum period of thirty (30) days from the order confirmation.

8.2. Risk Transfer

The risk is transferred to the Customer at the moment they physically take possession of the package.

In the event of a confirmed non-delivery, a new shipment or a refund will be offered.

In the event of an incorrect address provided by the Customer, the reshipping costs will be borne by the Customer.

9. Right of withdrawal

In accordance with Articles 102 et seq. of Royal Legislative Decree 1/2007:

The Customer has a period of fourteen (14) calendar days from receipt of the product to exercise his right of withdrawal, without having to justify his decision.

The request can be made by email or by any unambiguous written statement expressing the wish to withdraw.

The product(s) must be returned complete, in perfect condition, in their original packaging, without undue delay and at the latest within fourteen (14) days following the communication of the decision to withdraw.

Return shipping costs are the responsibility of the customer.

The refund will be issued within a maximum period of fourteen (14) days from the receipt of the returned products or the proof of shipment provided by the Customer, the date taken into account being that of the first of these events.

10. Legal Guarantee

The products are covered by the legal guarantee of conformity. 3 years in accordance with Spanish legislation.

In case of default, the Client may request:

• repair
• replacement
• price reduction
• refund

11. Responsibility

Firefightgroup SL acts as a distributor.

Its liability is limited to the amount paid for the order in question and to foreseeable direct damages.

The following are not covered:

• indirect losses
• loss of earnings
• damage to image

No clause limits the consumer's legal rights.

12. Force majeure

The company cannot be held liable in the event of:

• strike
• supply disruption
• health crisis
• administrative decision
• cyberattack
• event beyond his control

The execution will be suspended for the duration of the event.

13. Retail

Products are offered subject to availability.

The same rules regarding delivery, returns and warranty apply.

14. Personal data

The data is processed in accordance with:

• to the GDPR
• to Organic Law 3/2018

Purposes: order management, subscriptions, legal obligations.

The Client has the following rights: access, rectification, erasure, objection, limitation, portability.

15. Mediation and disputes

The Client may use the European platform:

https://ec.europa.eu/consumers/odr

In the event of a dispute, the consumer can take legal action in the courts of their place of residence.

16. Applicable Law

These Terms and Conditions are governed by Spanish law.

The Client benefits from the mandatory provisions of his country of residence within the EU.

17.Partial nullity

If a clause is declared invalid, the other provisions remain applicable.
